Final and binding arbitration is the award that is passed by an arbitrator/arbitration panel who has been giving the powers to adjudicate and end the dispute by the parties, where the arbitration is a form of Alternative Dispute Resolution. The laws require the two parties - the parties to the dispute – to have a written arbitration agreement whether as an arbitration clause in the original contract or entering into a specific arbitration agreement once a dispute has arisen.
